Police: Woman alleging assault vs. Chafin didn't cooperate in 2014

Waco Police say that a woman who came forward Tuesday and said she was assaulted by former Baylor running back Devin Chafin did not cooperate with any attempts to investigate the claims when she first reported them in 2014.

The woman, former Baylor student Dolores Lozano, said she would file a TItle IX suit against the school because Baylor's coaching staff knew about her assault allegations against Chafin. She said she was assaulted three times by Chafin.

Waco Police say Lozano reported to them in April 2014 that she was grabbed by Chafin, and her arm was slammed into a car door. They say she also reported that she was choked and slammed into the ground in March 2014, but that she had not told anyone about that incident. Police say Lozano refused a protective order and didn't let officers take any pictures of bruises on her arm. She then stopped cooperating with the investigation, so no further action was ever taken.

Waco Police Sgt. Patrick Swanton said Lozano told police she was too busy and would come back "the next day" when they asked to take pictures. Per police, she did not come back.

Chafin, who said he grabbed Lozano in 2014 "because she was fighting me," was dismissed earlier this spring by Baylor. He told KWTX that Lozano was emotional and hitting her when he grabbed her and told Joe Schad on Tuesday that he wasn't interviewed by police. Chafin has also said that while he went to Lebby to "vent," he never talked to Briles about the incident and doesn't know if he knew. Lebby is Briles' son-in-law.

The KWTX report also states Chafin said he was forced to do extra conditioning work as "punishment" for the incident with Lozano.

Baylor issued a statement to Schad Wednesday morning.

Because of the complex nature of dating and domestic violence, even when complainants report abuse to the police, their school and others, complainants may be reluctant to move forward with a campus or criminal investigation. In developing informed and sensitive responses, we must be open to understanding the unique dynamics of dating and domestic violence, including individual barriers and safety considerations and to supporting our students as they evaluate their options. Further, we are actively taking steps to ensure all of our students understand and trust the full range of resources available to them.

The incidents above were first described in a report from Outside the Lines that said Lozano was "uncertain" about pressing charges.

In the April 2014 case, a woman told Waco police that Bears running back Devin Chafin grabbed her arm and slammed it against a car, in front of teammates and another witness. She provided photos of bruises on her arm to police. She told police that, weeks earlier, Chafin had grabbed her by the throat and slammed her against a wall, then threw her to the floor and kicked her, according to a police report.

In the police report, the officer wrote that the woman was uncertain about pressing charges, and no legal action was taken. Chafin played in nine of 13 games the following season, including the season opener.

The same OTL report that mentioned the Chafin incident detailed the lengths that Waco police went to shield assault accusations against three different former players as well as the status of a rape accusation against a former player.

Briles was fired two weeks ago as Baylor's head coach. The rest of the football coaching staff has remained intact under acting head coach Jim Grobe.
