The attorney for the woman who accused Florida State quarterback Jameis Winston of sexual assault said that the woman's family will file a civil suit against him.
The woman's attorney, Pat Caroll, told ABC news that "I want heads to roll." Florida State Attorney Willie Meggs decided not to charge Winston with a crime in the incident that happened on Dec. 7, 2012.
"We have a duty as prosecutors to only file those charges if we have a reasonable likelihood of a conviction. After reviewing all of the evidence in the case, we feel that we could not meet that burden," Meggs said on Dec. 5, 2013.
Caroll also said that the civil suit would involve the Tallahassee Police Department and possibly the university as well.
"Absolutely you're going to see a civil suit," Carroll told ABC. "You can not have law enforcement that is not held accountable."
“The family is proceeding, with civil action against the TPD and Jameis Winston. And possibly the university.”
The case was handed over from campus police to Tallahassee police shortly after the incident occurred. The TPD said that they did not move forward with the case after the woman decided not to press charges while the woman's family issued a statement in November accusing a TPD detective of telling her to "think long and hard" about filing charges and that her life could be made miserable if she did so.
A DNA sample that Winston provided in November matched the DNA sample taken from the accuser in the hours after the incident. However, Winston's attorney said that the sex was consensual and Meggs said in his press conference that the presence of another DNA profile in the sample taken from the accuser was a key factor in his investigation.
Winston won the Heisman Trophy on December 14, a day after Carroll held a press conference in a park to call for an independent investigation into the case. The Seminoles won the BCS Championship Game on Monday, defeating Auburn 34-31 on a touchdown pass from Winston to Kelvin Benjamin with 13 seconds left.
