Waco police Sgt. W. Patrick Swanton said police interviewed the woman and filed a report but suspended the case without arresting Ukwuachu.
Police forwarded the case in March 2014 to the McLennan County District Attorney’s Office, which obtained an indictment against Ukwuachu three months later, according to court records.
His attorney told the Tribune that Ukwuachu had a previous relationship with the woman and that the allegations of sexual assault were surprising. He also said Ukwuachu hasn't been able to play for Baylor because of the indictment and hopes his client can take the field if he's not found guilty. Ukwuachu sat out 2013 as part of his transfer and wasn't eligible to play in 2014.
“We are looking forward to the trial,” Sibley said. “Sam passed a polygraph exam, he’s been cleared by Baylor and has graduated and is 100 percent innocent of these charges against him. He has done everything a man can do to clear his name, and he is looking forward to the trial so he can finally do that.”
Ukwuachu transferred from Boise State following the 2012 season. He was dismissed from the team for a violation of team rules by then-Boise State coach Chris Petersen. According to police records, he was involved in an alleged incident with a female in Boise that involved a broken window that led to a cut on his arm.
Ukwuachu's trial is set to begin on August 17. He last played football in 2012 and started Boise State's final 12 games of the season as a freshman. A native of Pearland, Texas, he was a three-star recruit in the class of 2011.
